PlayMetrics Privacy Notice

PlayMetrics cares about your privacy.  This Privacy Notice explains the practices of PlayMetrics with respect to personal data that PlayMetrics receives through the website PlayMetrics.com (the "Site"), the PlayMetrics mobile application (the “App”), and our related platforms, products, and services available on or through the Site or App (together with the Site and App, the "Services").  PlayMetrics, LLC, its parent eMinor Incorporated, and their respective affiliates, successors, and assigns are referred to in this Privacy Notice as "our", "we", "us", or "PlayMetrics". 


SCOPE

This Privacy Notice describes PlayMetrics’ practices with respect to personal data that we collect through the Services from users including, but not limited to, administrators, directors, coaches, managers, team staff, Ref Assignors, Organization marketing personnel, parents, guardians, players, volunteers, and other visitors to or users of the Services.  Please note that PlayMetrics is not responsible for the privacy practices of individual Organizations.  “Organization” means a club, national, state or local sports governing body, league, company, university, school, conference or other institution.  If you have any questions regarding how an Organization handles personal data, you should contact the Organization directly. “Personal data,” as used in this Privacy Notice, means information that identifies or can reasonably be linked to a specific individual. We use the term “information” in this Privacy Notice to refer to both personal data and information that does not identify and cannot reasonably be linked to a specific individual.


YOUR CONSENT TO THIS PRIVACY NOTICE
By using the Services you consent to the personal data practices described in this Privacy Notice including the use of Data Technologies (defined below) and disclosures of personal data described herein and to the monitoring of electronic communications as described in this Privacy Notice.  If you create a player profile for your child or children, then you consent also on behalf of your child or children, and you represent to PlayMetrics that you are duly authorized to so consent.  As we discuss under “Privacy of Children” below and in our Terms of Use, the Services are not intended for use by, and may not be used by, any child under the age of 13.


INFORMATION COLLECTED BY PLAYMETRICS
Information You Provide to Us

We collect the information that you directly provide to us, such as the following:

  • Registration Information.  Organization administrators, directors, coaches, managers, agents, and team staff (“Organization Personnel”) may provide personal data when establishing their account with PlayMetrics and using our Services.  This information may include name, email address, mobile phone number, and other contact information; Organization-related information; and billing and payment information. 
  • Player Contact. Registered users of our Services may provide certain information about themselves to create a player contact account “Player Contact”).  Organization Personnel may also create Player Contacts.  Player Contact-related information may include name, physical address, email address, phone number, and billing information. Registered users can change Player Contact information and communication preferences within the Site or App.
  • Player Profiles. Player Contacts may provide certain information about a player and such player will be associated with their account in order to establish a player profile ("Player Profiles").  Organization Personnel may also create Player Profiles which may be associated with Player Contacts.  Player Profile-related information may include names, address, photographs, birthdate, gender, dominant side, and biographical information. Certain Player Profile information, such as a player’s picture and name, will be displayed to the player's parent or legal guardian (Player Contact) linked to the Player Profile and to the player’s sports Organization Personnel, and other player contacts (parents/guardians) on the same team via the Organization Dashboard.  Other information related to a Player Profile, such as birthdate, proof of age, gender, dominant side, eligibility, attendance, injury status, and eligibility for financial assistance will be subject to access restrictions established by your Organization.  Authorized Player Contacts or Organization Personnel can change Player Profile information.
  • Recruiting Profiles. If enabled by a club and team, and elected and opted-in to the service by an authorized Player Contact, Player Contacts may provide certain information about their player(s) who are 16 years of age, or older, to create a Recruiting Profile for that particular player (“Recruiting Profiles”) to be available for distribution to Organization Personnel, recruiters or other third parties as may be designated. Recruiting Profile-related information may include names, school class year, photographs, height, weight, biographical information, team memberships (including high school and/or club teams), linked external video content, academic information, achievement information, freeform text copy, sport position, player number, dominant foot, and third-party contact information. Certain limited Recruiting Profile information, such as a player’s picture, name, school class year, player number, position, etc. will be generally accessible on a Recruiting Profile webpage, and all additional profile information will be available to any party with access to the corresponding link and access code to the applicable Recruiting Profile.
  • Service Inquiries or Demo Requests. We may collect personal information that you provide when you inquire about our Services or request a demo. This information may include your business information, including your first name, last name, email, phone number, Organization name, Organization size, and any other information you provide, including your interests in relation to our Services or applicable business information. We use this information to communicate with you about your inquiry or interests, provide the free trial or demo, or schedule an information call to discuss our Services.
  • Payment Information. If you make payments via our Services, we may collect the information provided in connection with your payment including your name, contact, and billing information.
  • Technical and Customer Support Information. We may ask you to provide contact information and information related to the issue you are contacting us about if you contact us for support.
  • Electronic Communications.  We collect personal data that you submit to the Services when you use features such as text messaging, blogs, newsletter sign ups, email, chat, surveys, or user-generated content. It is important to understand that you should have no expectation of privacy with respect to any electronic communications transmitted through the Services, including text messages, chat messages, emails, or blogs, and that PlayMetrics and our Service Providers (defined below) may monitor, inspect, record, and store the contents of these communications.  Your use of the Services constitutes your consent to the same. 
  • Events, Surveys, and Promotions. If you fill out any forms relating to PlayMetrics events, surveys, contests, sweepstakes, or other promotional events, we collect your contact and demographic information, and any other information requested on the form or at sign up. 
  • Social Media. When you interact with our Services through various social media, such as when you click on a social media provider’s icon on the Services, follow us on a social media site, or post a comment to one of our pages, we may receive information from the social network such as your profile information, profile picture, gender, user name, user ID associated with your social media account, age range, language, country, and any other information you permit the social network to share with third parties. The data we receive is dependent upon your privacy settings with the social network. We use this information to operate, maintain, and provide to you the features and functionality of the Services, as well as to communicate directly with you, such as to send you email messages about products and services that may be of interest to you.
  • Employment Applications. If you apply for employment, we may collect your contact and demographic information, educational and work history including the start and end dates of your employment, a summary or description of your employment, a copy of your CV, resume, examples of or links to your work product, employment interests, description of your degree, field of study or major, name of the institution from which you obtained your degree, the dates when you attended the institution and obtained your degree, information obtained during interviews, and any other information you choose to provide.


Automated Information Collection

We automatically collect information about your use of the Services (“Automated Data”) through certain technologies, including those provided by third parties. This data is used to improve the Services, to analyze trends, to administer the Site and App, to track users’ movements around the Site and App, and to gather demographic information about our user base as a whole. User IP addresses are recorded for security and monitoring purposes. Information collected in this manner may include:

  • Web browsing, network or service usage data, such as browser type, internet service provider (ISP), IP address, referring/exit pages, operating system, date/time stamp, and clickstream data.
  • Information collected through pixels or beacons in email communications and newsletters that we distribute that may identify whether and how you interacted with the email or newsletter, and may include information about the device you are using, including unique identifiers.   
  • Network connected hardware (e.g., computer, or mobile device) data, such as a unique device identifier, advertising ID, type, model, version, error related data, status, capability, configuration, functionality, performance data, and connection type.
  • Physical or geographic location data, such as country, region, state, and city.
  • Advertising data including display frequency, duration, location, or viewing software.

The technologies we use to collect Automated Data may include cookies, pixel tags, and web beacons and software development kits (“SDKs”) embedded in our App.  We describe these technologies and how we use them in “Use of Cookies and Other Data Technologies” below. 


Information We Receive From Third Parties

We may supplement the information that we collect with information that we obtain from Organization Personnel.  We may also obtain information from third party sources such as websites, online services, marketing partners, or others. We may combine the information we receive from these third parties with the information we directly collect, in which case we will handle it in accordance with this Privacy Notice. 


HOW PLAYMETRICS USES PERSONAL DATA

We use each of the categories of personal data described above for the following business and commercial purposes. The activities below can involve outside companies, agents, or contractors (“Service Providers”) to whom we disclose your personal data for these purposes.

  • To provide our Services, including the Site, App, and individual features and functions within our Services.
  • To register and authenticate users of our Services. 
  • To process your payments. 
  • To personalize your experience with the Services.
  • To communicate with you about products and services of PlayMetrics or others that we think you may find of value or interest, including through emails, text messages, push notifications, and in-app messages.
  • To offer and conduct surveys or promotions we think may interest you.
  • To provide updates about the latest developments and features of our Services.
  • To conduct marketing and market research.
  • To improve and enhance the Site and App and our overall Services.
  • To develop and deliver new products, services, and other offerings.
  • To deliver contextual or targeted advertising to prospective customers who visit our Site.  Please see “Third Party Advertising” below for more information on our digital advertising practices.
  • To provide technical support, maintenance advisories, and customer service.
  • To process your application for employment, evaluate your qualifications and communicate with you during the application process, and facilitate the onboarding process.  In some instances, we may use analytical tools and algorithms to help us to review the large quantities of application information that we receive. These tools and algorithms help us prioritize our review process and sort applications based on qualifications and capabilities necessary to perform the relevant role. These tools are used along with human judgment. We evaluate each individual candidate on their own merits.
  • To comply with legal and regulatory obligations and requests of governmental authorities.
  • To enforce our contractual rights or Terms of Use, or to protect the security and integrity of our business and our Service, including reviewing and auditing compliance with applicable law and our policies, and for fraud prevention and security monitoring.

Sometimes we aggregate or de-identify information so that it can no longer identify you, as defined under applicable laws. This helps us better understand our users, such as when we measure ad performance, create advertising interest-based segments, or compile survey results. We can use and disclose this aggregated or de-identified information for any purpose, unless an applicable law says otherwise. 


DISCLOSURE OF INFORMATION PLAYMETRICS COLLECTS

We may disclose personal data as described in this Privacy Notice or as otherwise communicated to you at the time we collect your information.  For example: 

  • We use Service Providers who assist us in operating our business, processing payments, providing the Services, maintaining technology and related infrastructure, customer support, providing recruitment and human resources services, distributing emails, managing surveys and promotions, data analytics, and marketing and advertising. 
  • We disclose personal data, such as Profile information, to your Organization including Organization Personnel and fellow members of your sports Organization that you subscribe to or access through our Services.  We may also disclose certain personal data to tournaments, tournament organizers or sponsors, and league or sports governing bodies or associations as part of the provision of our Services to you or your Organization.  By using our Services, you are directing us to disclose personal data to these recipients, and you are using our Services to intentionally interact with them.  Please note that once we share your personal data with your Organization, the personal data is no longer subject to this Privacy Notice.  You should contact your Organization for information about its privacy practices.
  • If your club and you opt-in to utilize the Recruiting Profile service, we disclose Recruiting Profile information for players 16 years of age or older, to your Organization including Organization Personnel, recruiters, and any other parties who may receive a link to the applicable Recruiting Profile.  Limited Recruiting Profile information will be generally accessible on the Recruiting Profile webpage, and all other Recruiting Profile information will be accessible by any party with access to the corresponding link and access code.  By using the Recruiting Profile services, you are directing us to disclose personal data to these recipients, and you are using the Recruiting Profile services to intentionally interact with them.  Please note that once we share the Recruiting Profile information with your Organization, a recruiter, or any party with access to the link to a particular Recruiting Profile, the personal data contained in the Recruiting Profile is no longer subject to this Privacy Notice.  You should contact your Organization, recruiters, or parties who receive links to Recruiting Profiles for information about their privacy practices.  You should not submit any information for a Recruiting Profile which you do not intend to make publicly available.
  • We disclose to or enable the collection of personal data by third party data analytics and digital advertising providers on our Site or App, as described in more detail in “Use of Cookies and Other Data Technologies” below.
  • We disclose personal data to our affiliates, who may use and disclose the information in accordance with this Privacy Notice.
  • We may disclose personal data to comply with law or legal process, protect and defend our rights and property, protect against misuse or authorized use of the Services, protect the safety or property of our personnel, users, or others, or cooperate with governmental authorities. 
  • In the event of a reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings), we may disclose or transfer your information to a third party such as an acquiring entity and its advisers.
  • We may disclose personal data to our or our affiliates’ professional advisers such as our legal representatives, auditors and insurance brokers. 


Information You Choose to Share with Others 

The Services may enable you or players to share personal data with third parties such as through chat, text, email, Recruiting Profiles, or other communication features.  You are responsible for the communications that you send and the personal data that you chose to share with others through these communication features.  When you send chats, texts, emails, or other communications through the Services, PlayMetrics, our Service Providers, Organization Personnel, and other individuals who use the Services may also have access to your communications.  As noted earlier in this Privacy Notice, you should have no expectation of privacy in connection with the use of these features.  Please note that any personal data you or others may share with social media or other third parties will become subject to the privacy policies of those third parties, and will no longer be subject to this Privacy Notice.


USE OF COOKIES AND OTHER DATA TECHNOLOGIES

PlayMetrics uses cookies and certain other data technologies (“Data Technologies”) on the Site and App, including those provided by third parties.  These Data Technologies are described below. For information about your choices, please use “User Choices” later in this Privacy notice.

Cookies.  A cookie is a small string of text that a website or online service stores on a user’s browser. It saves data on your browser about your visit to our site or other sites. It often includes a unique identifier.  You can choose whether to accept cookies by editing your browser settings. However, if cookies are refused, your experience with our Services may be impacted, and some features may not work as intended. 

Pixels.  Pixels (also known as “web beacons,” “GIFs” or “bugs”) are one-pixel transparent images located on web pages or in email messages. They track whether you have opened these web pages or emails. Upon firing, a pixel logs a visit to the current page or message and may read or set cookies.  Pixels often rely on cookies to work, so turning off cookies can impair them. But even if you turn off cookies, pixels can still detect a web page visit.  We may authorize third parties to embed pixels in the Services, and the operation of pixels may result in the sharing of personal data or de-identified or pseudonymized information with third parties, who may use the data and information to provide services to us or for their own purposes.

Scripts.  Javascript code or other scripts or code to monitor and analyze Site or App usage and traffic.

SDKs.  SDKs are pieces of code provided by our digital vendors (e.g., third-party advertising companies, ad networks and analytics providers) in our mobile apps to collect and analyze certain device and user data.

Our Services may also use a variety of other hardware or software specific technologies that automatically collect information.


USER CHOICES
Third Party Advertising 

When you use our Services, PlayMetrics or one of our web-advertising partners may collect information about your online activities so that we can deliver targeted advertisements tailored to your interests, including through the use of the Data Technologies described above.  The third-party advertisers, ad agencies, and other vendors with which we work may be members of the Network Advertising Initiative or the Digital Advertising Alliance Self-Regulatory Program for Online Behavioral Advertising. To opt out of interest-based advertising from the participating companies, please visit AboutAds.info for laptops and NAI Mobile Choices or AppChoices for mobile devices.  You can also visit Google's Ad Settings to manage the ads Google serves.  For information about how Google Analytics processes personal data, click here.  To provide users more choice on how their data is collected by Google Analytics, Google developed the Google Analytics Opt-out Browser Add-On.  Note that opting out through these channels does not mean you will no longer see ads and is specific to the device and browser you are using. You may still receive other types of ads from these companies, and any type of ad from nonparticipating companies. 


Emails 

You may opt out from receiving marketing emails from us by following the instructions in the email. Please note that you may still receive other email communications from us, such as in connection with transactions for our products and services or notifications concerning our policies.

Many email programs or services have settings which allow you to prevent the automatic downloading of images, including web beacons, which may prevent the automatic connection to the web servers that host those images and our collection of certain automated data as described earlier in this notice.


Do-Not-Track

Some browsers include a "Do Not Track" setting that can send a signal to the websites you visit indicating you do not wish to be tracked.  There is not a uniform technical standard how to interpret the Do Not Track signal; therefore, our Site does not respond to browser Do Not Track signals. 


LINKS, THIRD-PARTY WEBSITES, AND SOCIAL MEDIA PLATFORMS

Our Sites may contain links to third party websites such as sports Organization or team websites and social media platforms. PlayMetrics is not responsible for the privacy policies and/or practices on these or other third-party websites or mobile apps. When linking to another site, you should read the privacy policy on that site. This Privacy Notice only applies to the PlayMetrics Services.


PRIVACY OF CHILDREN

The Services are intended for use by persons 13 years of age or older.  We do not knowingly solicit or collect personal information from children under the age of 13.  The Services are not intended for use by, and may not be used by, any child under the age of 13.  Please notify us as provided below in the “Contact Us” section if you believe we may have collected such information without parental or guardian consent or other than in a manner authorized by law, and we will work to delete it promptly.


PlayMetrics is committed to protecting the privacy of children and we urge parents to regularly monitor and supervise their children's online activities.  We instruct Organization Personnel to input information into the Services about players under the age of 18 only with the consent of the child’s parent or legal guardian. Parents and legal guardians may provide information about their minor child as described in the “Information Collected By PlayMetrics” section above. Inquiries concerning the personal data we collect about your child may be directed to us using the information provided in the “Contact Us” section below. Please include the parent or legal guardian’s email address and telephone number in any written correspondence.  We will take reasonable steps to help verify a parent or legal guardian’s identity before responding to any such communications.


California law provides minors a right to remove, or to request removal of, content or information that they posted to a website, mobile application, or other types of online services while under the age of 18.  To request removal of any such content or information, please contact us at privacy@playmetrics.com.  Please note that the removal described in this paragraph does not ensure complete or comprehensive removal of the content or information that you may have posted on our Services. 


SECURITY

PlayMetrics takes reasonable security procedures, practices, and precautions designed to protect the security of the Services.  However, no method of electronic transmission or storage is 100% secure and PlayMetrics cannot guarantee the security of personal data. You are solely responsible for keeping your account secure and for maintaining the confidentiality of your password information.


INTERNATIONAL USERS

PlayMetrics Services are only for users in the United States or Canada. If you are located outside of the United States, or Canada you should not use our Sites and Services, as the information practices and the terms of this Privacy Notice may or may not comply with foreign law. By using our Sites and Services you consent to the use and disclosure of your information in accordance with this Privacy Notice and subject to the applicable laws of the United States and Canada.


YOUR CALIFORNIA PRIVACY RIGHTS

California law permits California residents to request certain information regarding disclosure of personal data to third parties for such third parties' direct marketing purposes during the past year. If you are a California resident, you may ask us to refrain from sharing your personal data with certain of our affiliates for their marketing purposes. You may make such a request by contacting us as specified in the “Contact Us” section below. 


Please include the full name and contact information for your PlayMetrics account in your request, and include the statement "Your California Privacy Rights" in the subject field of your letter or email. Please allow thirty (30) days for a response.


CHANGES TO OUR PRIVACY NOTICE

From time to time PlayMetrics may make changes to our Privacy Notice. If we do, we will post the revised version on our Site and change the “last updated” date at the top of this Notice. Your continued use of our Site, App and Services after any changes constitutes your acceptance of such changes. Please contact us as described in the “Contact Us” section if you would like information regarding any changes.
